Hazardous waste regulations

The Duty of Care Regulations state that as a waste holder you must take all reasonable steps to:

  • Prevent unauthorised or harmful deposit, treatment or disposal of waste
  • Ensure that all waste is disposed of with a business or individuals that have the correct and relevant environmental permit issued but the Environmental Agency like Recycling Lives
  • Prevent other parties from breaching permit conditions relevant to the type of waste they process
  • Provide an accurate description of the waste when it is transferred to another business or individual
  • Retain waste documentation about hazardous waste for three years

In addition, any waste holder must ensure that waste is transferred to a business or individual that is:

  • Registered as a carrier, broker or dealer of waste
  • A waste management operator with the relevant permit or registered exemption to accept such waste

Where can I recycle hazardous waste?
Recycling Lives Services aim to achieve a 100% recycling rate, which means that anything that can be recycled will be recycled.
What happens if I don’t fulfil my legal duty of care?
Breach of the duty of care is an offence, with a penalty of up to £5,000 on summary conviction or an unlimited fine on conviction on indictment.
Can I dispose of non-hazardous waste with my hazardous waste?
The mixing of different categories of hazardous waste or the mixing of hazardous waste with non-hazardous waste is prohibited under the regulations, unless the mixing is authorised by a permit or exemption.
What waste documentation is needed for hazardous waste?
All hazardous waste must be transferred with an accompanying consignment note, which is prepared before the waste is moved.
